01Agreement to these terms
This website, www.kaldrin.dev, is operated by Kaldrin Developments ("Kaldrin", "we", "us" or "our"). By accessing or using the website, you agree to these Terms & Conditions and to our Privacy Policy. If you don't agree, please don't use the website.
02The website and our services
The website provides general information about Kaldrin and the services we offer, including website design and development, logo design, branding and visual design, graphic and digital design, and digital infrastructure.
Nothing on the website is an offer, quote or binding commitment to provide services. Any project we take on is governed by a separate written proposal or agreement between you and Kaldrin. If that agreement conflicts with these terms, the agreement controls for that project.
03Rules for using the website
You may use the website to learn about Kaldrin and to contact us. When you do, you agree to:
- Use the website only for lawful purposes and in line with these terms
- Provide accurate information when you contact us, and only submit other people's information if you're authorised to
- Not interfere with the website's operation, security or other visitors' use of it
We may change, suspend or discontinue any part of the website at any time, and we may restrict access for anyone who breaks these terms.
04Intellectual property
The website and its content, including its text, design, layout, graphics, code, the Kaldrin Developments name, and the Kaldrin logo and three-pillar mark, are owned by Kaldrin or used with permission, and are protected by copyright, trademark and other laws.
The imagery on the website was created for Kaldrin Developments. Screenshots of client websites show work we designed and built for those clients, and the clients' own names, logos and content remain their property.
You may view the website and print or save pages for your own reference. You may not copy, reproduce, modify, distribute, republish or create derivative works from any part of the website, or use our name or logo, without our prior written permission.
If you send us ideas or feedback about the website, you agree we may use them without obligation to you. This does not apply to materials you share with us as part of a client project, which are covered by that project's agreement.
05Acceptable use
You agree not to:
- Use the website in a way that breaks any law or regulation
- Send spam, unsolicited advertising or bulk messages through the contact form
- Attempt to gain unauthorised access to the website, its servers or any connected systems
- Introduce viruses, malware or other harmful code
- Overload, disrupt or damage the website, including through denial-of-service attacks
- Use automated tools to scrape, crawl or copy the website's content, other than standard search engine indexing
- Impersonate any person or business, or misrepresent your affiliation with anyone
06Demonstrations and examples
The website includes demonstrations to show the kind of work we do. The "System demonstration", including the business "Northline Home Services", is fictional and illustrative. It is not a client project and does not represent real results, data or endorsements.
07Third-party links and content
The website may link to or load content from third-party websites and services, such as fonts and images. We don't control those third parties and aren't responsible for their content, policies or practices. Your use of third-party websites is at your own risk and subject to their terms.
08Disclaimers
The website and its content are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement.
We work to keep the website accurate and available, but we don't guarantee that it will be uninterrupted, error-free or free of harmful components, or that its content is complete or current. Content on the website is general information, not professional advice for your specific situation.
09Limitation of liability
To the fullest extent permitted by law, Kaldrin and its owners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of, or inability to use, the website, even if we've been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for any claim arising out of or related to the website is limited to one hundred U.S. dollars (US$100).
Some jurisdictions don't allow certain limitations, so some of the above may not apply to you. This section applies to use of the website only; liability for client work is set out in the relevant project agreement.
10Indemnity
You agree to indemnify and hold harmless Kaldrin and its owners from any claims, losses, liabilities and expenses, including reasonable legal fees, arising from your misuse of the website or your breach of these terms.
11Governing law
These terms and any dispute arising out of or relating to them or the website are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. You agree that any such dispute will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction.
12Changes to the terms
We may update these terms from time to time. We'll post the updated version on this page and change the "Last updated" date above. Changes apply from the date they're posted. By continuing to use the website after that, you accept the updated terms.
13General
If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these terms isn't a waiver of our right to do so later. These terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and Kaldrin about your use of the website.
